Why You Need a New Mexico Personal Injury Lawyer

Personal injury claims are often complex legal matters that can be difficult for most people to handle alone. Many accident victims prefer the help of a skilled attorney who has intricate knowledge of New Mexico’s personal injury laws and experience working with insurance companies to obtain fair and accurate results.

All too often, insurance companies will attempt to settle a claim quickly for the lowest amount of compensation possible. Unfortunately, this offer rarely reflects the true amount the victim’s claim is worth. With a personal injury lawyer as your advocate during the claims process, it will give you peace of mind that your right to fair and just compensation is protected. That way, you can focus on healing and recovery.

How Much Do Personal Injury Lawyers Cost?

Albuquerque personal injury lawyers typically offer free initial consultations to discuss your case. Once you have addressed any questions or concerns, and feel comfortable hiring an attorney, oftentimes you don’t have to pay any money up front. Instead, they work on a contingency fee basis. This means that your legal team is paid a certain percentage of any damages you are awarded; this percentage is something you agree upon in advance. If you do not recover any compensation in your case, you will not owe any attorney’s fees.

Types of Compensation Available to Personal Injury Victims

Personal injury victims can pursue a claim against a negligent defendant for the following two types of compensation:

Compensatory damages that exist to repay a victim for his or her losses resulting from a defendant’s negligence.

  • Medical Expenses: Compensation for all current and future medical costs related to the injury. Victims must prove the medical bills are related to the injury caused by the defendant.
  • Lost Income: If the injury forces a victim to take time off of work in order to recover, current and future lost wages can be claimed.
  • Property Damage: If any of a victim’s personal property is damaged or destroyed by the defendant’s negligent act, compensation can be recovered for the cost of repairing or replacing those items.
  • Pain and Suffering: Compensation for a victim’s physical pain, mental distress, and emotional suffering. A judge or jury will decide an appropriate amount to award after considering expert testimony and the victim’s overall state.

Punitive damages the court imposes, in some cases, to punish severely reckless or intentionally dangerous defendants.

Most of these damages are straightforward and easily calculated, while others like pain and suffering are subjective losses. A personal injury attorney can help you estimate the amount of compensatory damages you should recover, and if they believe punitive damages will be available.
